1. General Provisions
1.1. The sale of Goods through the Website is conducted by SUMOTORI Japan Co., Ltd. The parties to the sales contract are the Seller and the Customer.
1.2. This Agreement sets forth the terms and conditions for placing, paying for, fulfilling, and canceling Orders, delivering Products, and handling Customer inquiries.
1.3. Prior to payment, the Customer is provided with information about the Products, the contents of the Order, the total amount and currency of payment, shipping costs and terms, as well as the opportunity to review this Agreement and correct the Order details. The Agreement is considered concluded upon confirmation of successful payment for the Order via PayPal. The Seller sends an Order confirmation to the Customer’s email address.
1.4. This Agreement applies to Orders placed after the effective date of this version. Changes to the terms are not retroactive and do not alter agreements already concluded without the consent of the parties, except as expressly provided by applicable law.
1.5. The Seller reserves the right to update the terms and conditions for future Orders by publishing a new version with its effective date.
1.6. Orders for delivery to the Russian Federation are not accepted.
2. Registration and Customer Information
2.1. Registration and Order placement are carried out using the forms provided on the Website. The Customer must provide accurate information necessary for communication, payment, and delivery.
2.2. The Customer is responsible for keeping the password to their personal account secure. If unauthorized access is suspected, the Customer must immediately report it to info@azimka.ru.
2.3. If the Customer discovers an error in the address, the Recipient’s name, or contact information, they must contact the Seller as soon as possible. The ability to correct this information after shipment depends on the delivery service’s policies.
3. Placing and Fulfilling an Order
3.1. Orders are placed on the Website. When confirming an Order via email, the Seller will, prior to payment, specify the Order’s contents, total cost, and delivery terms, and provide a link to this Agreement.
3.2. To fulfill the Order, the following information is required: the Recipient’s first and last name, full shipping address including the ZIP code and destination country, contact phone number, and email address. Additional information is requested only if necessary to fulfill the Order or comply with legal requirements. Passport information is not a required field when placing a standard Order on the Website; if documents are required for customs clearance, the Customer shall provide them to the relevant authorized agency or operator upon request.
3.3. Order processing begins after confirmation of full payment via PayPal. Until payment is received, the availability of the Product is not reserved, unless otherwise expressly communicated to the Customer.
3.4. If a paid-for Product is unavailable, the Seller notifies the Customer and offers to cancel the relevant item or provide an agreed-upon replacement. Replacements and price increases are not permitted without the Customer’s consent. If no response is received within 7 business days, the unavailable item will be canceled, and the amount paid for it, along with any unused portion of the shipping cost associated with it, will be refunded. If the remaining portion of the Order is no longer of interest to the Customer, the parties shall agree to cancel the entire Order.
3.5. The Seller prepares and hands over the Order to Japan Post within 5 business days after payment confirmation. If the Order includes Products that require a longer delivery time from the supplier within Japan, the time for handing over the Order to Japan Post is up to 7 business days. Information about the extended delivery time is provided to the Customer prior to payment in the description of the relevant Product or during the Order placement process. If such an Order is shipped as a single package, the timeframe of up to 7 business days applies to the entire Order. The specified timeframes do not include international shipping and customs clearance.
3.6. In the event of a delay, the Seller shall notify the Customer, provide available information regarding the new delivery timeframe, and coordinate further actions. The Customer’s rights under applicable law in the event of a breach of delivery deadlines remain unaffected.
3.7. An unpaid order may be canceled after 7 business days. If the necessary information is missing to fulfill a paid Order, the Seller will first request it from the Customer. If fulfillment is not possible, the Order will be canceled and the payment refunded.
3.8. The description of the Product must correspond to its essential characteristics. The on-screen color representation and minor changes in packaging design may differ from the image, but this does not exclude liability for the delivery of a Product that does not conform to the agreed-upon characteristics. Any substantial substitution must be agreed upon with the Customer.
4. Delivery
4.1. Orders are shipped from Japan via Japan Post to countries and regions where the relevant shipping method is available, excluding the Russian Federation. Shipping availability also depends on the contents of the Order, weight, dimensions, postal restrictions, and import regulations for specific goods.
4.2. Available shipping methods, costs, and estimated delivery times are provided prior to payment. Delivery information is available at https://azimka.shop/delivery/. If, after payment, it becomes clear that shipment is not possible, the Seller will coordinate an acceptable solution with the Customer or cancel the Order and refund the amount paid.
4.3. Unless otherwise specified when placing the Order, import duties, destination country taxes, and customs clearance fees are not included in the shipping cost. The obligation to pay these is determined by the laws of the destination country. Taxes and fees included in the payment are specified prior to payment; additional charges, which the Seller is required to disclose in advance, may not be concealed from the Customer.
4.4. After shipment, the Seller provides shipment details, including a tracking number, if provided by the selected service.
4.5. Estimated delivery times depend on the operations of postal carriers, customs clearance, and route restrictions. The carrier’s involvement alone does not relieve the Seller of its obligations to the Customer.
4.6. The risk of accidental loss or damage to the Goods passes to the Customer upon actual receipt of the Goods by the Customer or by a Recipient designated by the Customer. The handover of the Order to Japan Post does not, in and of itself, signify the transfer of this risk to the Customer.
4.7. In the event of loss, damage, or a significant delay in delivery, the Customer shall contact the Seller. The Seller shall coordinate with the postal operator and fulfill the obligations regarding delivery, replacement, or refund as provided for in the Contract and applicable law. Consideration of the Customer’s claim is not contingent solely on the Seller’s receipt of an insurance payout or compensation from the carrier.
4.8. Upon receipt, it is recommended to inspect the packaging, quantity, and condition of the Goods. Visible damage should, if possible, be documented with the delivery service. The absence of an inspection report or video recording of the unpacking does not, in and of itself, deprive the Customer of their legal rights.
4.9. If a package is returned due to an incorrect address, refusal to accept delivery, or expiration of the storage period, the Seller will contact the Customer to arrange for a refund or reshipment. Any reimbursement of actual expenses is determined by the reason for the return and applicable law; automatic forfeiture of the entire payment is not permitted.
5. Price and Payment
5.1. The price of the Goods, shipping costs, applicable taxes and discounts, the total amount, and the payment currency are communicated to the Customer prior to payment confirmation. The display of a reference equivalent in another currency does not change the currency specified at the payment stage.
5.2. Payment is made exclusively via PayPal to the Seller. Order processing begins after confirmation of successful full payment. The payment methods available within PayPal are determined by the payment service itself.
5.3. Any currency conversion and bank or PayPal fees are determined by the terms of the respective service. The Customer must verify the information provided to them before confirming payment.
5.4. The Seller reserves the right to change prices and discount terms for future Orders. The price of an Order that has already been paid for will not be increased unilaterally.
5.5. If a pricing error is discovered, the Seller will contact the Customer. Any additional payment or replacement requires the Customer’s consent; the consequences of an error in a contract that has already been concluded are determined by applicable law. In the event of a lawful cancellation of a paid Order, the Seller shall refund the corresponding payment.
6. Cancellation, Returns, and Defects in the Product
6.1. The Customer has the right to cancel an Order before it is handed over to the delivery service by sending a request to info@azimka.ru with the Order number. If canceled before shipment, the amount paid for the canceled Order will be refunded, including the cost of the undelivered shipment.
6.2. After shipment, the Seller does not accept voluntary returns or exchanges of Goods of satisfactory quality due to a change of mind by the Customer, an erroneous selection, or personal preferences. This provision does not limit the Customer’s statutory rights to withdraw from the contract, request a refund, or seek other remedies provided for by applicable law. Where such a right exists, the time limits, procedures, and exceptions prescribed by law shall apply.
6.3. If the Product is delivered damaged, has defects, does not conform to the Order, or if part of the paid-for Products is missing, the Customer should contact info@azimka.ru and provide the Order number and a description of the problem.
6.4. Please report any visible damage or discrepancies as soon as possible, preferably within 7 calendar days of receipt. This internal deadline does not limit the statutory time limits for filing claims or the rights regarding hidden defects.
6.5. If possible, please attach photos of the Product, the outer and inner packaging, and the shipping label to your inquiry. It is recommended that you retain the Product and its packaging until you receive further instructions. The absence of photographs, the original outer packaging, or a video recording does not in itself preclude consideration of the claim or invalidate your statutory rights.
6.6. The Seller will review the claim and propose a solution provided for by applicable law: replacement, repair, a proportionate price reduction, or a refund, taking into account the nature of the violation and the Customer’s legal right to choose.
6.7. If the resolution of the claim requires the return of a damaged, defective, or incorrectly shipped Product, the Seller will provide the return address and shipping instructions and will cover the necessary costs. The return procedure must be agreed upon in advance, without limiting the Customer’s rights as provided by law.
6.8. Refunds are processed through PayPal via the original transaction within the timeframes established by applicable law. The refund is credited in accordance with PayPal’s rules to the original payment method; the time it actually appears in the account also depends on the bank or card issuer. The Seller notifies the Customer once the refund has been processed.
6.9. The procedure is also published on the “Returns and Exchanges” page. This page does not limit the rights provided for in this Agreement and by mandatory provisions of law. The terms of the PayPal Buyer Protection Program apply separately and are not superseded by the terms of this Agreement.
7. Intellectual Property
7.1. The text, images, trademarks, and other materials on the Site may belong to the Seller or the respective rights holders. The mere publication of material on the Site does not in itself imply that the Seller holds exclusive rights to it.
7.2. Use of such materials is permitted only with the permission of the relevant rights holder or on the grounds provided by law. Mention of a brand does not imply that the Seller has the status of an official or exclusive representative, unless such status is expressly stated and confirmed.
8. Liability
8.1. The parties are liable for the performance of their obligations in accordance with the Agreement and applicable law. The Agreement does not exclude liability that cannot be excluded or limited by agreement between the parties.
8.2. The Customer must follow the instructions and warnings regarding the use and storage of the Product. The consequences of using the Product in violation of such instructions shall be assessed taking into account the causes of the damage and applicable law; this provision does not exclude liability for defects in the Product or for inaccurate information about it.
8.3. Links to external websites are provided for convenience. The Seller does not control such websites and does not guarantee their availability. This does not relieve the Seller of liability for its own statements and actions.
8.4. The use of postal operators, payment services, and technical service providers does not constitute a substitution for the Seller under the Contract. The transfer of the contract or obligations to another party is permitted only in compliance with the requirements of applicable law and with the necessary consents.
9. Personal Data and Privacy
9.1. SUMOTORI Japan Co., Ltd. is responsible for processing Customers’ personal data when placing and fulfilling new Orders. Questions regarding data processing should be directed to info@azimka.ru.
9.2. Data is used to the extent necessary to create and maintain a personal account, process, pay for, and deliver an Order, communicate with the Customer, address inquiries, ensure security, and fulfill the Seller’s legal obligations.
9.3. Data necessary for payment, delivery, and the operation of the Website may be processed by the relevant payment, postal, and technical service providers on the grounds provided by law. PayPal processes payment information in accordance with its terms and conditions and privacy policy. Further details regarding data recipients, international transfers, and processing conditions are provided in the Website’s Privacy Policy.
9.4. Acceptance of the Agreement does not constitute unconditional consent to receive promotional communications. Marketing communications are sent only when there is a valid legal basis, including separate consent when required. The customer may opt out of marketing communications; this does not prevent the receipt of service messages regarding the Order.
9.5. Information regarding the use of cookies, technical data, and analytics tools is disclosed in the Privacy Policy and relevant notices on the Website. If the use of certain technologies requires consent, it is requested separately.
9.6. The Customer may submit a request to access, correct, or delete their data, or to have certain processing activities discontinued, within the limits of applicable law. Some information may be retained for periods established by law, including for the purpose of recording transactions and protecting legal claims. Deleting your personal account does not automatically result in the deletion of all documentation related to completed transactions.
10. Governing Law and Disputes
10.1. This Agreement is governed by the laws of Japan. This choice does not deprive the Customer of the protections provided by mandatory provisions of law applicable to the relevant consumer contract, including the laws of the Customer’s country of habitual residence, where applicable.
10.2. For questions regarding the performance of the Agreement and to file claims, the Customer shall contact info@azimka.ru, specifying the Order number and the nature of the inquiry. The Parties shall endeavor to resolve disputes through negotiation. Contacting the Seller does not limit the remedies provided by law.
10.3. If no agreement is reached, the dispute shall be resolved by a competent court in accordance with the applicable rules of jurisdiction. This Agreement does not establish exclusive jurisdiction that would deprive the Customer of their statutory right to bring a claim before a court.
10.4. The invalidity of any individual provision shall not render the remaining provisions of this Agreement invalid, unless otherwise provided by applicable law.
